a.

Confirmatory memorial number YL591119

The "Remarks" column under this memorial shows that the document is a confirmatory assignment of assignment memorial number YL496157. At times, doubts may arise as to the efficacy of an assignment due to clerical or other mistakes. In such a case, the assignor may execute a confirmatory assignment in favour of the assignee to confirm or otherwise assure the validity of the assignment in question so as to remove any doubt in respect of the title of the property.

   
b.

Letter and survey plan memorial number YL496156

This could be a letter issued by or on behalf of the developer to the District Lands Office regarding re-development of the land on which the property is located. The property to which this land register relates is probably part of a village house that has been re-developed on the land and the survey plan in question sets out the location of the property.

   
c.

No objection letter memorial number YL591120

Under the Buildings Ordinance (Application to the New Territories) Ordinance (Cap.121), a village house in the New Territories not exceeding certain dimensions provided in the Ordinance is exempt from the provisions of the Buildings Ordinance. The Director of Lands will issue a certificate of exemption in respect of building works where a village house qualifies for exemption and no building plans will need to be approved by the Building Authority. Hence, no occupation permit under the Buildings Ordinance will be issued for the village house.

If an exempted village house is on land held under a government lease (as opposed to conditions of grant), a certificate of compliance will not be issued. In these circumstances, the District Lands Office will usually issue to the owner a no objection letter (in this case, memorial number YL591120) which provides that there is no objection for persons to occupy the village house. It should be noted that there may be certain disclaimers in the no objection letter. For example, the act of issuing the letter does not amount to the government having represented that the property is structurally safe.
