Land Search Sample 6 - residential property sold under the Consent Scheme

a.

Consent to enter into agreement for sale and purchase dated 8/8/2003

Under the Consent Scheme, a developer shall not, before the conditions in the land grant have been complied with, enter into any agreement for sale and purchase of units in the uncompleted development unless and until consent in writing is obtained from the Director of Lands.

   
b.

Modification letter memorial number UB3921714

A modification letter is issued by the Government where the developer's application to modify certain covenants and conditions (for example, extension of the building covenant period) contained in the government grant (in this case the conditions of exchange no.11000) has been approved.

   
c.

Statutory declaration memorial number UB4408433

This statutory declaration was made by the solicitor acting for the developer pursuant to the conditions in the consent to sell. The purpose of the statutory declaration is to protect purchasers of units in the uncompleted development. The solicitor for the developer has to declare the stage of construction of the development, arrangements for finance and that the form of the agreement for sale and purchase conforms with the approved form, etc.

Deed poll memorial number UB4506042

As can be seen from the "Remarks" column, the deed poll relates to the change of name of the development. The deed poll has to be registered to enable the Land Registry to update its records so that subsequent registration of documents relating to the development can be effected in the new name.

Agreement memorial number 05050701290019 shows that the purchasers of the property were Lam Tai and Cheung Shan purchasing the property as tenants-in-common in equal shares. Nomination memorial number 05051502180018 indicates that Cheung Shan has nominated Lam Tai to take up Cheung Shan's half share in the property and directing the vendor (Lam Kam Lan) to assign all estate and interest in the property to Lam Tai. As a result of the nomination Lam Tai has become the sole owner of the property by assignment memorial number 05070502120019.

Generally, unless the nominator and the nominee are specified relatives (one of them is a parent, spouse or child of the other), the nomination is subject to stamp duty under the Stamp Duty Ordinance (Cap.117).

When dealing with a property with a nomination registered in the land register, it must be ascertained that the nominator has relinquished all rights in the property. It is therefore prudent to seek legal advice before entering into a provisional agreement for sale and purchase for such a property.

From the 14-digit memorial number of each of the three documents, we know that they were all delivered for registration after the implementation of the Central Registration System.
