Land Search Sample 1 - residential property with no subsisting encumbrance

a.

Land register

From the prefix (TP) appearing before a memorial number, we can see that all registered documents shown on the land register in question are documents delivered for registration at the Tai Po New Territories Land Registry before the implementation of the Central Registration System.

Government lease

The property is held under a government grant, the term of which is from 22 May 1991 to 30 June 2047.

Government rent

There is no information in this column, but if reference is made to the "Remarks" column below, the amount of government rent per annum payable after 30 June 1997 is stated to be 3% of the rateable value of the lot (pursuant to Article 3 of Annex III of the Joint Declaration).

Joint tenancy

Chow Wing Man and Chung Yuet Lin currently hold the property as joint tenants. The legal implications of this include: (i) all documents affecting the property, for example, agreement for sale and purchase or assignment of the property, should be signed and executed by both of them; and (ii) if one of them pre-deceases the other, the survivor will take the pre-deceased owner's interest in the property. The developer ABC Development Limited took out a building mortgage to obtain a loan from XYZ Bank Limited to finance the construction of the development. The appearance of receipt on discharge memorial number TP289888 immediately after building mortgage memorial number TP235569 on the land register indicates that the said building mortgage has been discharged.

An occupation permit is issued by the Building Authority when a building is allowed to be occupied. The occupation permit sets out the user of different parts of the building.

Deed of mutual covenant memorial number TP321204

The deed of mutual covenant (commonly known as the "DMC") is a deed usually entered into between the developer, the first purchaser of a unit in the building and the manager of the building. It sets out the rights and obligations of the owners of units in the building. It also provides for other matters pertinent to the management of the building, for example, prohibiting certain use of certain parts of the building, regulating the use of common areas, and the appointment of a management company as manager. The terms of the deed of mutual covenant shall not be contrary to the Building Management Ordinance (Cap.344). The Ordinance also provides for mandatory terms to be incorporated into a deed of mutual covenant, for example, the keeping of accounts by the manager.

Agreement for sale and purchase memorial number TP322000

The agreement for sale and purchase was entered into by the developer and the present owners of the property (Chow Wing Man and Chung Yuet Lin) before they completed the purchase of the property by assignment memorial number TP324157. Before they completed the purchase, their interest in the property was only equitable.

Legal charge memorial number 324158 and release memorial number 401002

A legal charge or mortgage is a document entered into by a borrower and his financier (usually a bank or a financial institution) under which a property is used as collateral or security for a loan. In this case, the legal charge is an "all monies" legal charge which means that the property is security for the repayment of all sums due and owing from time to time by the borrower under the legal charge without upper limit. Release memorial number TP401002 appears to have discharged legal charge memorial number TP324158.
