Land Search Sample 4 - residential property subject to building order

a.

Building orders memorial numbers UB2693456 and UB5634900 and letter of compliance memorial number UB3862475

Two building orders are shown in the land register. They were both issued under Section 24(1) of the Buildings Ordinance. This indicates there were unauthorised building works affecting the property at the time. Copies of these orders can be obtained from the Land Registry to ascertain the nature and extent of such unauthorised works. Non-compliance with these orders would lead to enforcement action, including government re-entry. When the Building Authority is satisfied that such an order has been complied with, a letter of compliance will be issued.

In this case, the first building order under memorial number UB2693456 appears to have been satisfied by letter of compliance memorial number UB3862475.

Certificate under Section 33(1) of the Buildings Ordinance memorial number UB6333117 and memorial of satisfaction memorial number UB7771933

In respect of the other building order memorial number UB5634900, it appears that the Building Authority has, under Section 33(9) of the Buildings Ordinance, registered a memorial of the certificate of costs, incurred by the government in carrying out the works required by the said building order (memorial number UB6333117), against the property which constitutes a first charge on the property for the recovery of cost of works incurred by the government due to the owner's failure to carry out works required by the building order. The registration of the memorial of satisfaction (memorial number UB7771933) indicates that the Building Authority has recovered the sum certified under the certificate of costs and the first charge has consequently been discharged.

Notice of intention to proceed memorial number UB6767677 and memorandum of discharge memorial number UB7275513

It appears from the notice of intention to proceed that Tsang Yip Siu Ling, the petitioner, applied for ancillary relief in the District Court Divorce Jurisdiction (D.C.D.J.) in suit number 4567 of 1996 against Tsang Ho Yan (the then owner of the property).

In matrimonial proceedings, the court has wide discretionary powers under the provisions of the Matrimonial Proceedings and Property Ordinance (Cap.192) to make financial provision for the parties and children concerned and to order the transfer or sale of property, etc. Accordingly, it is important to have regard to the terms of any court orders made with respect to property involved in divorce proceedings to see if there is any restriction on the registered owner's power to dispose of the property. In the present case, a purchaser from Tsang Ho Yan should review the content of Memorandum of Discharge memorial number UB7275513 to ascertain if Tsang Ho Yan could freely dispose of the property in spite of the application for ancillary relief.

Plans annexed to agreement for sale and purchase and assignment

A plan was annexed to assignment memorial number UB291568. A plan was also annexed to the subsequent agreement for sale and purchase memorial number UB8107124. To ascertain the content of the two plans and whether any alteration of the property is involved, copies of the plans can be obtained from the Land Registry. Should there be any doubt as to the legality of any alteration to the property, it would be prudent for the purchaser to seek appropriate professional advice.
