(1) Introduction
 

The law on tenancy in Hong Kong is basically governed by the Landlord and Tenant (Consolidation) Ordinance (Cap. 7) ("the Ordinance"), common law, and the terms and conditions contained in a tenancy agreement. This monograph deals mainly with tenancy matters pertaining to residential properties. The following analysis looks at: the legal requirements for the creation of a tenancy and related matters; contents of a tenancy agreement and the implied covenants of the landlord and the tenant; application of Part IV of the Ordinance. The analysis concludes with an illustration of tenancy practice and procedure.
