The law on tenancy in Hong
Kong is basically governed by the Landlord and Tenant (Consolidation)
Ordinance (Cap. 7) ("the Ordinance"), common law,
and the terms and conditions contained in a tenancy agreement.
This monograph deals mainly with tenancy matters pertaining
to residential properties. The following analysis looks at:
the legal requirements for the creation of a tenancy and related
matters; contents of a tenancy agreement and the implied covenants
of the landlord and the tenant; application of Part IV of
the Ordinance. The analysis concludes with an illustration
of tenancy practice and procedure.
