2.40 Switching of types of licence

| 2.40.1 |
A holder of an estate agent's licence may apply for the grant of a salesperson's licence without having to fulfil the educational or examination requirements under the LR provided that, where his licence is subject to the requirement to comply with the examination/training requirement on or before a date specified in the licence, he has fulfilled that requirement.

A holder of a salesperson's licence may apply for the grant of an estate agent's licence without having to fulfil the educational or examination requirements under the LR provided that
| (a) | | where his licence is subject to the requirement to comply with the examination/training requirement on or before a date specified in the licence, he has fulfilled that requirement; and
|
| (b) | | he has at any time passed a qualifying examination for estate agents or, where he is a senior practitioner he has completed a training course for estate agents on or before 31 December 2001.

2.41 Re-entering the Trade

| 2.41.1 |
An ex-holder of an estate agent's or salesperson's licence (as the case may be) may apply for the same type of licence without having to fulfil the educational or examination requirements under the LR provided that
| (a) | | he makes the application within the relevant period (see para. 2.42 below); and
|
| (b) | | where his licence was subject to the requirement to comply with the examination/training requirement on or before a date specified in the licence, he has fulfilled that requirement.

| 2.41.2 |
An ex-holder of an estate agent's licence may apply for the grant of a salesperson's licence without having to fulfil the educational or examination requirements under the LR provided that
| (a) | | he makes the application within the relevant period (see para. 2.42 below); and
|
| (b) | | where his licence was subject to the requirement to comply with the examination/training requirement on or before a date specified in the licence, he has fulfilled that requirement.

| 2.41.3 |
An ex-holder of a salesperson's licence may apply for the grant of an estate agent's licence without having to fulfil the educational or examination requirements under the LR provided that
| (a) | | he makes the application within the relevant period (see para. 2.42 below);
|
| (b) | | where his licence was subject to the requirement to comply with the examination/training requirement on or before a date specified in the licence, he has fulfilled that requirement; and
|
| (c) | | he has at any time passed a qualifying examination for estate agents or, where he is a senior practitioner he has completed a training course for estate agents on or before 31 December 2001.

| 2.42.1 |
For the purposes of para. 2.41 above, an individual makes an application for the grant of a licence within the relevant period if the application is made within 24 months from -
| (a) | | where the licence that the individual has held was suspended, the date on which the suspension took effect, or where the suspension had ceased to have effect before the licence expired, the day following the expiration of the licence; or
|
| (b) | | in any other case, the day on which the licence ceased to be valid, whether by reason of its expiration or otherwise.
