The Estate Agents Ordinance (Cap.511) ("Ordinance") provides for the
licensing and the regulation of the estate agency trade.
The Estate Agents Authority established thereunder
is empowered to, inter alia, regulate and control the practice
of estate agents and salespersons and to take such actions
as the Authority considers appropriate or necessary to promote
integrity and competence amongst, or maintain or enhance the
status of, estate agents and salespersons.
The Authority is also empowered by the Ordinance
to make regulations governing different aspects of estate agency practice
and to prescribe documents for use by the estate
agency trade.
Estate agents and salespersons must comply
with the Ordinance and its subsidiary legislation, including in particular the Practice Regulation in respect of Hong Kong residential properties.
They should also comply with the Code of Ethics and Practice Circulars issued by the Authority.
EAA has published a Guide to the Estate Agents Ordinance which offers practitioners a guide to the key provisions in the ordinance.
