Personal Data (Privacy) Ordinance
Practitioners are reminded that,
to comply with the Data Protection Principles of the Personal
Data (Privacy) Ordinance (Cap. 486), the collection of personal
data from a client by an estate agent shall be for a purpose
necessary for the performance of estate agency work for that
client and such data shall be collected by lawful and fair
means. An agent shall not use such personal data for any purpose
other than that for which the data was collected or disclose
such data to any other person, unless with the consent of
his client.
If the prospective purchaser
has obtained, with the vendor's consent and through the agent,
any personal data of the vendor, the agent should remind him
to handle the information in accordance with the Personal
Data (Privacy) Ordinance.
